- TERMS OF SERVICE ("TOS") FOR MYNETGEAR.COM SUBSCRIBERS AND RELATED SERVICES
By completing the registration process, you ("Customer") are indicating your agreement to be bound by the TOS. These TOS apply to your mynetgear.com subscription, application or use of your mynetgear.com domain, and any services performed or provided to you in connection with your application or use of the mynetgear.com subscription or your mynetgear.com domain ("Services").
- USE OF CUSTOMER INFORMATION AND PRIVACY POLICY
No personally identifiable information that you provide NETGEAR will be disclosed by NETGEAR, except to NETGEAR's partners as required to provide the Services or as permitted by this TOS. By becoming a mynetgear.com subscriber, you agree that NETGEAR may share with other parties both aggregate information and limited individual information gathered during your use of your mynetgear.com subscription. "Aggregate information" is information that describes the habits, usage patterns and/or demographics of customers as a group but does not indicate the identity of particular customers. "Individual information" is information about a customer presented in a form distinguishable from information relating to other customers but not in a form that enables the recipient to identify any particular customer. See our Privacy Policy for complete information on NETGEAR's policies regarding customer information.
- OWNERSHIP OF SITE CONTENT
NETGEAR and/or its suppliers and/or its licensors wholly owns all articles, illustrations, programs, services, processes, designs, software, technologies, trademarks, trade names, inventions, and materials on mynetgear.com.
- ACCEPTABLE USE
- Customer certifies that he or she is at least 18 years of age.
- Customer is solely responsible for his/her usage of the Services. Each Customer is responsible for ensuring that all authorized users of its system or network are aware of and follow this TOS. Customer's use of the Services is subject to, and Customer agrees to comply with, all applicable local, state, national, and international laws and regulations, including but not limited to U.S. law regarding the transmission of technical data exported from the United States.
- Customer may use the Services for lawful purposes, so long as he or she does not (i) abuse or fraudulently use the Services, (ii) use the Services in a manner that causes interference to or tampers with another subscriber's or authorized user's use of the NETGEAR Services, or (iii) otherwise use the Services in a manner that violates this TOS.
- Activities that fall within the scope of C(i), (ii) or (iii) above include, but are not limited to, the following:
- transmitting Unsolicited Commercial Email (UCE)
- transmitting bulk email
- posting bulk Usenet articles
- Denial of Service attacks
- copyright infringement
- failure to provide legitimate contact information
- misrepresentation of NETGEAR's services
- reselling or attempting to resell NETGEAR's services
- unlawful or illegal activities
- use of web redirects for distributed file sharing software and networks
- pointing NETGEAR hostnames to a public IRC network
- pointing hostnames on NETGEAR owned domains to an IRC server
- causing or creating service degradation for other NETGEAR Users, whether intentional or inadvertent
- causing or attempting to cause harm to another computer or network
- utilizing the Services under more than one account
- search engine spamming
- distributing or promoting pornographic material using the Services
- TERMINATION OF SERVICE
NETGEAR may suspend or terminate your account or access rights to your Services at any time, without notice, for conduct that NETGEAR reasonably believes violates this TOS or any applicable laws or regulations. In addition to restricting or terminating Customer's access to the Services, NETGEAR may remove materials that we have reasonable grounds to believe are in violation of the copyright laws of the United States or may be otherwise illegal, may subject NETGEAR to liability or that violate these TOS. NETGEAR may also cooperate with legal authorities and/or third parties in the investigation of any suspected criminal activity.
- INDEMNIFICATION
Customer agrees to hold NETGEAR harmless from any claims, whether brought by Customer or by a third party, and expenses, including reasonable attorney's fees and court costs, related to or arising from Customer's breach or violation of any of the terms of this TOS, or from any information, software or content placed by Customer on a server accessible through the Services.
- CHOICE OF LAW
This TOS shall be construed and controlled by the laws of the State of California. Any dispute arising from the terms of this TOS or a breach of this TOS will be governed by the laws of California without regard to the conflicts of laws provisions thereof, and shall be brought in a state or federal court in California. Customer agrees to submit to the personal jurisdiction of any of those courts.
- ENTIRE AGREEMENT
This TOS constitutes the entire agreement between the parties with respect to the subject matter contained herein and supersedes all previous and contemporaneous agreements, proposals and communications, written or oral between NETGEAR and/or its representatives and Customer. NETGEAR may amend or modify this TOS or impose new conditions at any time upon written notice from NETGEAR to Customer, either by email or by publication on the NETGEAR Web site. Any use of the Services by Customer after such notice shall be deemed to constitute acceptance by Customer of such amendments, modifications or new conditions.
- NO RESALE OF THIS SERVICE
Customer's right to use the Services is personal to Customer. Customer agrees not to resell the Services without the express consent of NETGEAR.
- DISCLAIMER OF RESPONSIBILITY FOR THIRD PARTY CONTENT
NETGEAR assumes no responsibility for the content of any material located on third party servers outside its control, including all servers accessed through the Services. NETGEAR has no control over web sites or other material hosted on external servers.
- LIMITATION OF LIABILITY AND WARRANTY
NO WARRANTY: YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE OF THE SERVICES IS AT YOUR SOLE RISK AND THAT THE ENTIRE RISK AS TO SATISFACTORY QUALITY, PERFORMANCE, ACCURACY AND EFFORT IS WITH YOU. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND, AND NETGEAR HEREBY DISCLAIMS ALL WARRANTIES AND CONDITIONS WITH RESPECT TO THE SERVICES, EITHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES AND/OR CONDITIONS OF MERCHANTABILITY, OF SATISFACTORY QUALITY, OF FITNESS FOR A PARTICULAR PURPOSE, OF ACCURACY, OF QUIET ENJOYMENT, AND NON-INFRINGEMENT OF THIRD PARTY RIGHTS. NETGEAR DOES NOT WARRANT AGAINST INTERFERENCE WITH YOUR ENJOYMENT OF THE SERVICES, THAT THE FUNCTIONS CONTAINED IN, OR SERVICES PERFORMED OR PROVIDED BY, THE SERVICES WILL MEET YOUR REQUIREMENTS, THAT THE OPERATION OF THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT DEFECTS IN THE SERVICES WILL BE CORRECTED. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY NETGEAR OR ITS AUTHORIZED REPRESENTATIVE SHALL CREATE A WARRANTY. SHOULD THE SERVICES PROVE DEFECTIVE, YOU ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR OR CORRECTION. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR LIMITATIONS ON APPLICABLE STATUTORY RIGHTS OF A CONSUMER, SO THE ABOVE EXCLUSION AND LIMITATIONS MAY NOT APPLY TO YOU.
TO THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT SHALL NETGEAR BE LIABLE FOR PERSONAL INJURY, OR ANY INCIDENTAL, SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THE SERVICES, HOWEVER CAUSED, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT OR OTHERWISE) AND EVEN IF NETGEAR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OF LIABILITY FOR PERSONAL INJURY, OR OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THIS LIMITATION MAY NOT APPLY TO YOU. In no event shall NETGEAR's total liability to you for all damages (other than as may be required by applicable law in cases involving personal injury) exceed the amount of fifty dollars ($50.00). The foregoing limitations will apply even if the above stated remedy fails of its essential purpose.
- FEES, PAYMENT AND TERM OF SERVICE.
As consideration for the Services, you agree to pay NETGEAR the applicable service(s) fees, if any, set forth on our Web site at the time of your selection. All fees are due immediately and are non-refundable. Unless otherwise specified, each Service is for a one-year term. Any renewal of your Services with us is subject to our then current terms and conditions and payment of all applicable service fees at the time of renewal. NETGEAR reserves the right to seek remedy in the event of fraudulent payment, chargeback or otherwise uncollectible fees including, but not limited to, suspending all services rendered on said domain name or commencing litigation.
